Your Acceptance of These Terms

This section describes how these Terms form a binding contract between you and us. If you use the service on behalf of a legal entity, the legal entity also agrees to these Terms.

These Terms are a legally binding contract (“Agreement”) between you and Fetish Revival. When we say “you” or “your,” we mean you individually and any legal entity exercising rights under this Agreement through you. When we say “Fetish Revival,” “we,” “our,” or “us,” we mean Fetish Revival, LLC.

By accessing and/or using the Service, you agree to be bound by this Agreement and any policies or guidelines incorporated by reference into this Agreement (which will become part of the Agreement). If you do not agree to abide by all of the terms and conditions in this Agreement, you must not access and/or use the Service. You represent that you have the authority to bind yourself to this Agreement. If you access and/or use the Service on behalf of a legal entity, then you represent that you have authority to bind that legal entity to this Agreement and that the legal entity accepts this Agreement.

This Agreement applies to the Fetish Revival platform and all related content, tools, features, and services, including the Fetish Revival mobile app (on any and all formats or devices), and the website located at https://www.fetishrevival.com (collectively, the “Service”). The Service provides an online social marketplace where users of the Service (“Users”) can list and sell items (“Items”). When Users purchase Items, they are “Buyers,” and when Users sell Items, they are “Sellers.” Users may, at different times, be both Buyers and Sellers on the Service. By using the Service, Buyers and Sellers enter into a contract for the sale and purchase of Items directly between themselves, and Fetish Revival is not a party to such sale or purchase.

Please read this Agreement carefully as it, to the extent legally allowable in your jurisdiction, requires you and Fetish Revival to resolve most disputes solely through arbitration on an individual basis and not as a class arbitration, class action, any other kind of representative proceeding, or by jury trial. Fetish Revival will not be liable for any loss or damage arising from your failure to comply with the Agreement.

Overview

Fetish Revival is an online marketplace that allows users to buy and sell new or secondhand clothing and accessories, including dancewear, fetish wear, and related fashion items. We provide the platform for transactions between users but do not own, inspect, or guarantee any items listed by sellers.

Eligibility

To use Fetish Revival, you must:

• Be at least 18 years old.

• Have the legal capacity to enter into binding contracts.

• Comply with all applicable local, state, and federal laws regarding the sale and purchase of clothing and accessories.

If you use Fetish Revival on behalf of a business, you represent that you have the authority to bind that business to these Terms.

Account Registration

You may need to create an account to access certain features. You agree to:

• Provide accurate, current, and complete information.

• You must not provide any false information or impersonate another person or company through your account.

• Keep your login credentials secure.

• Notify us immediately of any unauthorized use of your account.

• You are solely responsible for any activity on your Account.

Fetish Revival reserves the right to verify the account information you provide (“Account Information”). Upon Fetish Revival’s request, you will promptly provide requested verification documentation, including identification documents, proof of address, or business information. The name on your Account will be considered the Account owner.

Fetish Revival reserves the right to suspend or terminate accounts that violate these Terms or our community guidelines.

Account Transfers

You cannot transfer or assign your Account to a third party without prior written consent from Fetish Revival. Fetish Revival may require additional information from you regarding the requested transfer or assignment. You cannot otherwise transfer, sell, or dispose of your Account under any circumstances.

Your Use of Service

You may only use the Service if you comply with the law and this Agreement. If you do not comply, then we can take certain actions, including termination of your Account or other legal or investigatory action. By using the Service, you may interact with other Users. You release us from all liability relating to your interactions with other Users. When interacting with other Users, you assume all the risks of your interactions. You will be solely responsible and liable for your use of the Service, including buying, selling, transacting, and communicating on the Service. All forms of interaction must follow our Community Guidelines (which are incorporated by reference into this Agreement).

Marketplace Transactions

a. Sellers

Sellers are responsible for:

• Accurately describing items, including condition, size, and material.

• Setting fair prices and applicable shipping costs.

• Complying with any local laws regarding the sale of used or specialty clothing.

b. Buyers

Buyers agree to:

• Review item descriptions carefully before purchasing.

• Pay the total amount owed for items purchased (including shipping and fees).

• Understand that all sales are between individual users unless otherwise stated.

c. Fetish Revival’s Role

We do not own or inspect listed items.

Fetish Revival provides a safe environment for transactions, but we are not a party to transactions between buyers and sellers and does not handle disputes beyond facilitating communication.

You will be responsible for your interactions with other Users, and you release Fetish Revival from any liability or responsibility arising out of disputes with other Users. We encourage Users to resolve disputes with one another amicably. You are solely responsible for your interactions with other Users, including any purchase or sale transactions.

Fetish Revival has no obligation to resolve disputes between Users, but Fetish Revival reserves the right to attempt to help Users resolve disputes. You release Fetish Revival from any claims, demands, and damages arising out of any disputes with other Users.

Prohibited Items and Content

You may not list, sell, or post content that includes:

• Explicit nudity or adult content.

• Items that promote hate, violence, or illegal activity.

• Counterfeit or stolen goods.

• Items that violate intellectual property rights.

• Used intimate garments that cannot be resold under local health regulations.

We reserve the right to remove listings or suspend accounts that violate these rules.

Fees and Payments

Fetish Revival may charge transaction or listing fees, which will be disclosed prior to posting or purchasing. Payments are processed through secure third-party payment processors. We do not store credit card information.

All fees are non-refundable unless otherwise required by law.

Shipping and Returns

Sellers are responsible for timely shipping and providing tracking information. Buyers should confirm delivery details before completing a purchase.

Unless specified by the seller, all sales are final. Fetish Revival is not responsible for items lost or damaged in transit.

User Conduct

You agree not to:

• Use Fetish Revival for fraudulent or deceptive purposes.

• Harass, threaten, or defame other users.

• Upload viruses or malicious code.

• Attempt to interfere with the operation of the Platform.

Violation of these rules may result in account suspension or permanent removal.

Intellectual Property

All content, branding, and materials on Fetish Revival (including logos, text, graphics, and software) are owned or licensed by Fetish Revival and protected under copyright and trademark laws.

You may not reproduce, distribute, or modify any content without prior written permission.

Disclaimer of Warranties

Fetish Revival provides the Platform “as is” and without warranties of any kind. We do not guarantee:

• The accuracy or reliability of listings.

• That transactions will be successful or error-free.

• The quality or condition of items purchased.

Fetish Revival is an online marketplace that provides a platform through which independent buyers and sellers may communicate and conduct transactions. Fetish Revival does not manufacture, own, inspect, authenticate, certify, endorse, or guarantee any item offered for sale on the Platform.

All listings, descriptions, photographs, pricing, and representations are created solely by the individual seller. Sellers are solely responsible for ensuring that their listings are accurate, lawful, complete, and do not infringe upon the rights of any third party.

Fetish Revival does not guarantee the authenticity, condition, quality, legality, safety, merchantability, fitness for a particular purpose, or availability of any item listed on the Platform. Buyers purchase items entirely at their own discretion and risk.

Fetish Revival is not responsible for disputes regarding product quality, sizing, authenticity, shipping delays, damaged merchandise, lost packages, or any other issues arising between buyers and sellers. While Fetish Revival may, in its sole discretion, assist users in resolving disputes, we have no obligation to investigate or resolve any disagreement between users.

Limitation of Liability

To the fullest extent permitted by law, Fetish Revival and its owners, employees, and affiliates shall not be liable for:

• Any indirect, incidental, or consequential damages.

• Loss of data, profits, or goodwill.

• Any issues arising from user-to-user transactions.

Fetish Revival is solely a marketplace platform that connects independent buyers and sellers. Fetish Revival is not a party to any transaction between users and does not own, inspect, authenticate, store, sell, or ship items listed on the marketplace. All purchases, sales, communications, disputes, refunds, returns, warranties, and claims arise solely between the buyer and the seller.

To the fullest extent permitted by applicable law, buyers and sellers agree that their legal rights and remedies regarding any transaction are limited to recourse against the other party to that transaction. Fetish Revival shall not be liable for any loss, damage, claim, or dispute arising from or relating to transactions conducted through the marketplace, except as otherwise required by applicable law.

Seller Representations and Warranties

By listing an item for sale, you represent and warrant that:

• You are the lawful owner of the item or otherwise have the legal authority to sell it.

• The item is not stolen, counterfeit, or unlawfully obtained.

• The listing accurately describes the item, including its condition, defects, and material characteristics.

• All photographs, videos, and descriptions are your original work or you possess the legal right to use them.

• The item complies with all applicable federal, state, local, and international laws and regulations.

• The sale of the item does not violate any intellectual property, trademark, copyright, publicity, or privacy rights of any third party.

You agree to indemnify and hold Fetish Revival harmless from any claims arising from inaccurate listings or unauthorized sales.

Buyer Assumption of Risk

Buyers acknowledge that many items offered through the Platform are previously owned and may exhibit normal wear, age-related characteristics, or minor imperfections. Buyers are responsible for reviewing all listing information, photographs, measurements, and seller communications before completing a purchase. Color variations, sizing differences, and condition assessments may vary depending on lighting, display settings, and manufacturer specifications.

Except where otherwise required by law, purchases are made at the buyer's own risk.

Chargebacks

Users agree not to initiate fraudulent or abusive payment disputes or chargebacks. If a chargeback is initiated without a valid legal basis, Fetish Revival reserves the right to suspend or terminate the user's account, recover all associated fees, report fraudulent activity to payment processors, and pursue any remedies available under applicable law.

Seller Verification

Fetish Revival reserves the right, at any time and in its sole discretion, to request identity verification, proof of ownership, proof of address, business registration documents, or any other documentation reasonably necessary to verify a user's identity or authority to sell listed items. Failure to provide requested documentation may result in listing removal, account suspension, delayed payouts, or permanent termination of the account.

Electronic Communications

By creating an account or using the Platform, you consent to receive communications from Fetish Revival electronically, including emails, platform notifications, legal notices, security alerts, transactional messages, and updates regarding your account. You agree that such electronic communications satisfy any legal requirement that communications be provided in writing.

No Agency Relationship

Nothing contained in these Terms creates any partnership, joint venture, employment relationship, agency relationship, franchise, or fiduciary relationship between Fetish Revival and any user.

Sellers act solely on their own behalf and are not employees, agents, representatives, or partners of Fetish Revival. Buyers contract directly with sellers when purchasing items through the Platform.

Force Majeure

Fetish Revival shall not be liable for any delay, interruption, or failure to perform resulting from causes beyond its reasonable control, including acts of God, natural disasters, hurricanes, floods, fires, epidemics, pandemics, labor disputes, internet outages, cyberattacks, governmental actions, power failures, payment processor interruptions, telecommunications failures, or other events beyond our reasonable control.

Survival

Any provisions of these Terms that by their nature should survive termination, including but not limited to intellectual property rights, indemnification, limitation of liability, dispute resolution, arbitration, governing law, payment obligations, and warranty disclaimers, shall survive termination of your account or your use of the Platform.

Severability

If any provision of these Terms is determined to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, Community Guidelines, Seller Policies, Prohibited Items Policy, and any other policies expressly incorporated by reference, constitute the entire agreement between you and Fetish Revival regarding your use of the Platform and supersede all prior agreements, communications, and understandings.

Reservation of Rights

Fetish Revival reserves the right, in its sole discretion, to investigate suspected violations of these Terms, remove listings or content, refuse service, suspend or terminate accounts, preserve evidence, cooperate with law enforcement authorities, and take any other action deemed necessary to protect the Platform, its users, or the public.

Adult Marketplace Standards

Fetish Revival is an adult-oriented marketplace intended exclusively for individuals who are at least eighteen (18) years of age.

Users may not upload, list, sell, advertise, or distribute content or items that include:

• Sexually explicit images or videos depicting sexual acts.

• Child sexual abuse material or any exploitative content involving minors.

• Non-consensual intimate imagery.

• Escort, prostitution, or sexual services.

• Human trafficking or exploitation.

• Bestiality or unlawful obscene material.

• Illegal drugs, weapons, or other prohibited goods.

• Any item prohibited by applicable federal, state, or local law.

Fetish Revival reserves the right to remove any listing or account that violates these standards without prior notice and may report suspected unlawful activity to the appropriate authorities.

Fetish Revival respects the intellectual property rights of others and expects all users of the Platform to do the same. It is our policy to respond promptly to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. § 512. If you believe that material available on the Platform infringes your copyright, you may submit a written notification to Fetish Revival's designated Copyright Agent in accordance with the requirements of the DMCA. Upon receipt of a valid notification, Fetish Revival will investigate the claim and, where appropriate, remove or disable access to the allegedly infringing material.

Fetish Revival reserves the right to remove content alleged to be infringing without prior notice and, where appropriate, to suspend or terminate the accounts of users who are determined to be repeat copyright infringers.

Nothing contained in this Policy shall be construed as an admission of liability or infringement. Fetish Revival acts as an online service provider hosting user-generated content and does not pre-screen or endorse user submissions. Users remain solely responsible for the content they upload, post, list, or otherwise make available through the Platform.

Knowingly submitting false or fraudulent copyright claims or counter-notifications may subject the submitting party to liability under applicable law, including 17 U.S.C. § 512(f). Fetish Revival reserves all rights and remedies available under applicable copyright and intellectual property laws.

DMCA Counter-Notification Procedure

If you believe that material you posted on Fetish Revival was removed or disabled as a result of mistake or misidentification, you may submit a written counter-notification to our designated Copyright Agent pursuant to the Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. § 512(g).

A valid counter-notification must include:

• Your physical or electronic signature;

• Identification of the material that has been removed or disabled and the location where the material appeared before it was removed;

• A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification;

• Your name, mailing address, telephone number, and email address;

• A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside the United States, the jurisdiction of the Federal District Court for Palm Beach County, Florida, and that you will accept service of process from the person who submitted the original DMCA notice.

Upon receipt of a valid counter-notification, Fetish Revival may restore the removed material in accordance with the procedures established by the DMCA unless the original complainant files an action seeking a court order to restrain the alleged infringing activity.

Fetish Revival has adopted and reasonably implements a policy of terminating, in appropriate circumstances, the accounts of users who are determined to be repeat copyright infringers.

Termination

We may suspend or terminate your account at any time for violating these Terms, engaging in fraudulent activity, or harming the integrity of the Platform.

Your use of Fetish Revival is also governed by our Privacy Policy, which explains how we collect and use your personal data. Please review it before using the Platform.

Arbitration / Dispute Resolution Clause

a. Agreement to Arbitrate

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Except as otherwise provided in these Terms, you and Fetish Revival agree that any dispute, claim, controversy, or cause of action arising out of or relating to these Terms, your use of the Platform, any transaction conducted through the Platform, or your relationship with Fetish Revival shall be resolved exclusively through final and binding arbitration rather than in court. This arbitration agreement applies to all claims, whether based in contract, tort, statute, fraud, misrepresentation, negligence, or any other legal theory, and survives termination of your account or your relationship with Fetish Revival.

b. Informal Resolution

Before initiating arbitration, both parties agree to make a good faith effort to resolve the dispute informally.

The party asserting the claim must send written notice describing the dispute and the requested resolution. Both parties agree to attempt to resolve the matter within thirty (30) days before commencing arbitration.

c. Arbitration Rules

If the dispute cannot be resolved informally, it shall be administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules then in effect, except as modified by these Terms.

Information regarding the AAA and its rules may be found at www.adr.org.

d. Arbitration Location

Unless otherwise agreed by the parties, arbitration shall take place in Palm Beach County, Florida.

If permitted under the applicable AAA Rules, arbitration may be conducted remotely by telephone, videoconference, or through written submissions.

e. Individual Arbitration Only

YOU AND FETISH REVIVAL AGREE THAT ALL DISPUTES SHALL BE RESOLVED SOLELY ON AN INDIVIDUAL BASIS.

Neither party shall participate in any class action, class arbitration, consolidated action, representative action, or private attorney general action.

The arbitrator shall have no authority to consolidate claims or preside over any class or representative proceeding.

f. Waiver of Jury Trial

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AND FETISH REVIVAL EACH KNOWINGLY AND VOLUNTARILY WAIVE ANY RIGHT TO A TRIAL BY JURY.

g. Small Claims Court

Nothing in this section prevents either party from bringing an individual claim in a court of competent jurisdiction if the claim qualifies for small claims court.

h. Exceptions

The following claims are not subject to mandatory arbitration:

• Intellectual property disputes;

• Copyright or trademark infringement claims;

• DMCA-related disputes;

• Requests for temporary restraining orders or other emergency injunctive relief;

• Claims that applicable law prohibits from being arbitrated.

Either party may seek equitable or injunctive relief in a court of competent jurisdiction to prevent the unauthorized use of intellectual property or confidential information.

i. Arbitration Costs

Each party shall be responsible for its own attorneys' fees and costs unless otherwise provided by applicable law or awarded by the arbitrator.

Administrative and arbitrator fees shall be allocated in accordance with the applicable AAA Rules.

j. Governing Law

This Arbitration Agreement shall be governed by the Federal Arbitration Act ("FAA"), 9 U.S.C. §§ 1-16, to the fullest extent permitted by law.

Except where preempted by the FAA, these Terms shall be governed by the laws of the State of Florida without regard to its conflict of law principles.

k. Time Limitation

Any claim arising out of or relating to these Terms or the Platform must be commenced within one (1) year after the claim arises, unless a longer period is required by applicable law.

l. Severability

If any portion of this Arbitration Agreement is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect, except that if the prohibition on class or representative actions is found unenforceable, this entire Arbitration Agreement shall be null and void.

m. Right to Opt Out

You may opt out of this Arbitration Agreement by sending written notice to Fetish Revival within thirty (30) days of first creating your account.

Your notice must include your full name, mailing address, email address associated with your account, and a clear statement that you wish to opt out of arbitration.

Opting out of arbitration will not affect any other provision of these Terms.

Indemnification Clause

You agree to indemnify and hold harmless Fetish Revival, its affiliates, and employees from any claim or demand arising from your use of the Platform, violation of these Terms, or infringement of any third-party rights.

Tax Responsibility

Sellers are solely responsible for reporting and paying any applicable taxes related to their sales. Fetish Revival does not collect or remit sales taxes on behalf of users unless required by law.

Third-Party Services Disclaimer

The Platform may contain links or integrations to third-party services. Fetish Revival is not responsible for the privacy practices, security, or content of these services.

User-Generated Content Rights

By posting content, you grant Fetish Revival a worldwide, non-exclusive, royalty-free license to use, reproduce, and distribute your content for the purpose of operating and promoting the Platform.

Beta or Platform Changes Disclaimer

Fetish Revival may modify, suspend, or discontinue parts of the Platform at any time without notice. We are not liable for any resulting loss of access or data.

Accessibility and Non-Discrimination

Fetish Revival is committed to providing a platform that is accessible, inclusive, and free from discrimination. Users agree to respect others regardless of gender, identity, race, or background.

Changes to These Terms

We may update these Terms at any time. Updated versions will be posted with a new “Last Updated” date. Continued use of the Platform constitutes acceptance of the revised Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any disputes not subject to the Arbitration and Dispute Resolution section of these Terms, or any action to enforce an arbitration award or seek injunctive relief as permitted herein, shall be brought exclusively in the state or federal courts located in Palm Beach County, Florida. The parties’ consent to the exclusive jurisdiction and venue of such courts.
